With jurisdiction of May 12th, 1998 - 312
O 85/98 - "Liability for links" the district court
of Hamburg has ruled that the web site operator,
by using a hyperlink, may be held responsible for
the content of the linked page. The operator is
only able to prevent this by dissociation from
those contents.
"Insofar as we refer directly or indirectly to
external web sites (links), we shall not be liable
for the content, availability, correctness and
accuracy of the linked pages, their offers, links
or advertising. Nor are we liable for any illegal,
incorrect or incomplete content and, in
particular, for any damage arising as the result
of the use or non-use of information supplied on
the linked pages." |
